TERMS AND CONDITIONS
These general
contracting conditions are applicable to all commercial transactions carried
out on the website, www.e3plus.pt, domain owned by E+3 PLUS, LDA, Tax Number 514109114,
headquarters at Travessa do Escairo nº45, Zip Code 4750-398 Carapeços-Barcelos
(PORTUGAL) dedicated, among other activities, to online sale of clothing.
The system, created
in this way, presupposes an active process on the part of the client, who is an
internet user, with a valid and working email address, an individual or the
representative of a legal entity, whether professional or particular, with the resources
needed to use the service.
These general
conditions on online sales are the basis of the commercial relationship between
E+3 PLUS and its customers, within the scope of a distance sales system, and
both parties accept them without reservation. Before placing an order for
products, the customer declares that he is fully aware of the following
provisions expressly and that he irrevocably accepts the terms described below.
DEFINITIONS
Web Site - The site:
which can be accessed through the address: https://www.e3plus.pt where E+3
PLUS, LDA offers products for purchase by the buyer.
Buyer – Customer: the
natural person or representative of a legal, professional or particular entity,
who buys one or more products made available for sale by the company E+3 PLUS, LDA
through the Web Site.
Seller – the company
through its legal representative, with which the Customer concludes a distance
selling contract.
Parties: Buyer and
Seller.
Order: The purchase
order, on the website, for one or more products.
SUBJECT
The purpose of these
general conditions is to establish the purchase conditions that the Customer
subscribes to, without reservations, for the use of the Website, in order to
choose one or more products selected and displayed by the supplier, to proceed
with the purchase and to obtain delivery to the place of your choice.
Our offers are aimed
at private customers, entities, individuals or legal entities, for their own
use.
ORDER
User
Data
In order to establish
a commercial relationship with E+3 PLUS, LDA on the website (www.e3plus.pt),
the customer can create a user account, and for that purpose, must introduce an
ID (valid email) and a password. The user ID and password are proof of the
customer identity and commit him to any orders placed. The customer undertakes
to keep their website access passwords confidentially and with the utmost care.
The customers access data are their responsibility and they hold them
responsible for the consequences that may result from any use by third parties,
improperly and/or without their knowledge.
The customer
undertakes to always provide reliable information about the data requested in
the user registration form and to keep them updated at all times.
If the customer
forgets the access data or suspects that they have become known to a third
party, the site allows the customer to change the password at any time.
Using your ID (email
contact) and password, the customer can later access the site in order to place
orders.
It is the customer
responsibility to carefully check the information provided and the products
that are the object of his order, before confirming the purchase.
The order processing
system allows you to review the order in order to change or correct any errors
before confirming the respective purchase. E+3 PLUS, LDA cannot be held
responsible for errors on the part of the Client.
In the case of sale
or commercialization of products made available by E+3 PLUS, for which it is
necessary for the buyer to be of a certain age, according to the legislation in
force in his country of origin, the buyer will have to confirm that he meets
this requirement in order to be able to formalize the purchase.
Order
Confirmation
Placing an order
represents acceptance of the price, the characteristics of the products
presented on the website and the delivery conditions.
The customer places
an order by adding the items he wishes to purchase to his "shopping
cart" and following the purchase process steps defined on the website. At
the end of this process, which includes the registration process on the
website, in order to identify the buyer, the order is sent via telematics to E+3
PLUS, LDA to be processed. If the customer completes his order by clicking
"Buy", he will receive a confirmation via e-mail for information that
his order has been received.
Rejection
of an order by E+3 PLUS
E+3 PLUS, LDA has the
right to reject any order for any legitimate reason, that is, in case of proven
financial difficulties on the part of the buyer – payment irregularities –
predictable problems that affect delivery, orders made in bad faith, or even to
confirm the identity of the buyer, requesting that official proof be provided
in this regard.
DELIVERIES
E+3 PLUS, LDA will
send the orders to its customers by the most convenient carrier, between DHL,
UPS, DPD or National Post Office. As a rule, it takes 4-5 business days via
carrier to Europe. Countries outside of Europe it could take 5-8 business days
via carrier. However, we remind you that we are not responsible for delays. The
delivery date at the customer home depends on the availability of the product
and the shipping area, as well as possible delays by Carrier. Shipments will
always be made after payment receiving and confirmation by our financial
department.
TO ALERT THAT THESE
ARE THE DEADLINES FOR THE DELIVERY OF THE PRODUCT FROM THE TIME IT LEAVES OUR
FACILITIES. Product processing time depends on immediate availability. In the
case of a product that mentions "available in 2 weeks" in the
description, the customer must wait 2 weeks for processing plus the days
mentioned for the delivery time by the carrier.
PRICES
Prices are expressed in euros (including VAT),
other applicable taxes must be paid by the Customer at the customs in their
country of origin (if applicable), unless otherwise specified on the Website.
As a result of fluctuations in exchange rates, the
adjustment of transport costs, materials, etc., these prices may be subject to
change, and E+3 PLUS, LDA do reserves the right to modify its prices without
prior notice.
Customers located outside mainland Portugal must
obtain information about import duties or taxes that may apply to their orders
and assume full responsibility for declaration and payment purposes.
The price of the product does not include shipping
costs, which will be billed in addition to the price of the products purchased,
taking into account the amount of the order. These shipping costs will be
indicated before the final validation and payment of the order by the customer.
Prices include the value added tax (VAT) applicable
on the day of the order and any change in the applicable rate will be
automatically reflected in the price of the products sold by E+3 PLUS, LDA.

order, the customer will have to pay for the orders made by him, by bank
transfer or PAYPAL:

In certain cases, and
in order to prevent possible fraud, E+3 PLUS, LDA reserves the right to ask a
customer for a specific payment method, in case of raising doubts about the
identity of the buyer.
SALE
CANCELLATION
If the Customer fails
to fulfil any of its obligations, in particular those relating to payment, E+3
PLUS, LDA reserves the right to automatically cancel the sale and recover
ownership of the goods. Any possible deposits and partial payments made by the
Customer will remain in the Supplier possession as initial compensation, without
prejudice to any further claims.
UNABLE
TO DELIVER
By express agreement,
all events of any nature beyond the control of E+3 PLUS, LDA including
exceptional circumstances, force majeure, accidents, strikes, official
decisions or transport stoppages, which may delay, prevent or increase
exorbitantly the cost of delivery, represent a reason for the suspension or
termination of obligations by E+3 PLUS, LDA, without any compensation to the
Customer.
E+3 PLUS, LDA will
inform the Customer, by any appropriate means, of the existence of such events
and will refund the cost of the undelivered Order. A new order can be
scheduled, based on conditions to be agreed upon, if requested by the Customer.
RETURNS
AND EXCHANGES POLICY
Returns
The contractual right to return products applies
exclusively to products that can be returned under the same conditions in which
the customer received them. Please return the item, using or including the
original packaging. It must also include all instructions, labels, documents
and packaging of the products. No refund will be made if the product has been
used beyond simply opening its packaging or if it has been damaged; therefore,
the customer should be careful with the products while they are in their
possession.
The customer must exercise his right to return the
products by returning the products, informing E+3 PLUS of his intention to
return the products and proceed with the delivery of the articles within a
period of 14 days from the date of the Confirmation of Delivery.
RETURNS OF PERSONALIZED PRODUCTS ARE NOT ALLOWED,
except for manufacturing defects.
Shipping and collection costs will always be the
responsibility of the customer. If the item is not in a condition to be
returned, it is the responsibility of the customer to collect it within 14 days
after confirmation by our team that the item does not present conditions for
return, after that period the responsibility for the item no longer belongs to
us, being the same destroyed.
Exchanges
The customer will
have a period of 14 days from the receipt of the order to return the product(s)
purchased in order to make the exchange. The customer must inform E+3 PLUS
within the stipulated period and, by any of the agreed means, the desire to
exercise their right to terminate the contract.
For the exchange to
be successful, the product must be in perfect condition (without odors, without
having been washed or altered), have the label and still present the purchase
receipt.
Shipping and
collection costs will always be the responsibility of the customer. If the item
is not in conditions to be exchanged, it is the responsibility of the customer
to collect it within 14 days after confirmation by our team that the article
does not present conditions for exchange, after that period the responsibility
for the item no longer belongs to us, being the same destroyed.
EXCHANGES OF
PERSONALIZED PRODUCTS ARE NOT ALLOWED, except for manufacturing defects.
Products that, by
mistake, does not correspond to the order:
E+3 PLUS will be responsible
for the costs of incorrect shipping and for the delivery of the item
corresponding to the order placed, without additional costs for the buyer.

Conditions applicable
to Standard products. Items made to measure or customized by the customer
(sizes, colors, or other customizations) are not subject to returns and
exchanges. Except in cases where they have an original defect, which will be
exchanged for an article of the same reference.
PRODUCTS
AND WEB INFORMATION
The products that
appear on the website comply with current Portuguese legislation and applicable
regulations in Portugal. If this is not the case, the offending product will be
removed from the website as soon as possible.
Note: Product colours
may vary and may not be exact, as they depend on the monitor and technology
used by each user. E+3 PLUS is not responsible for the inaccuracy resulting
from the statement above.
Information on
product availability is provided when the Buyer places his order. There may be
errors or modifications in exceptional cases, specifically in the case of
simultaneous orders for the same product from a larger number of Buyers. In the
event that a product is not available after an order has been placed, the
supplier will inform the Buyer by email or telephone as soon as possible and
will offer a series of solutions:
- OR postpone the
delivery, while waiting for the supply of this product, whenever possible;
- OR order another
product that appears on the website as a substitute;
- OR cancel the
order. If the Buyer chooses to cancel the order, the cost will be refunded
within a maximum period of 15 days from the date of payment, at the latest, if
payment has taken place.
E+3 PLUS reserves the
right to modify the website commercial offer (changes in products, prices,
promotions and other commercial and service conditions) at any time, even if
said changes are not applied to sales already performed.
E+3 PLUS strives
daily to provide information truthfully and without typographical errors. If at
any given moment an error of this kind occurs, beyond the will of E+3 PLUS, it
will be corrected immediately. If there is a typographical error in any of the
prices referred and a customer has made a purchase decision based on that
error, E+3 PLUS will notify the customer about the error and the customer will
be entitled to rescind their purchase, at no cost to your part.
The contents of the
website may, on occasions, show temporary information about the nature of some
products. In case the information provided to the customer does not correspond
to the characteristics of the product, the customer will have the right to
cancel his purchase, free of charge.
